By making a payment, both parties agree this contract is true and binding. The buyer has read and agree to the below terms and all the information provided is true and accurate.
The buyer acknowledges that he/she has read, understands, agrees to, and has received a copy of this contract. This contract is legally binding to the Parties. Neither Party shall have the right to modify this contract except by mutual agreement, in writing. This contract applies to the buyer listed Parties listed below. Both parties will retain a copy of the contract. The parties acknowledge that this contract was made in the State of Ohio. If any legal action is instituted, the parties agree that the proper jurisdiction and venue lies in the state of Ohio, in Miami County. Both parties’ consent to venue and jurisdiction in Miami County and waive the right to a trial by jury.
This contract is between the buyer and KittyCatKat, LLC / Tina L. Humphrey hereafter known as the breeder/seller. Pick of kitten(s) goes by date of deposit.
In submitting the non-refundable deposit payment to KittyCatKat, LLC, the buyer agrees to the following:
Registration
Registration application will be given to the buyer as soon as the kitten(s)/cat(s) is altered. If the pet kitten(s) is not altered prior to delivery, the buyer understands the pet kitten(s) must be altered prior to the age of 6 months. The pet owner IS responsible for alteration before receiving the registration application. Retiring cat(s) will come with registration and will be altered. Kitten/cat(s) registration available: CFF (Cat Fanciers Federation)
Pet Kitten/Cat
This kitten/cat(s) is being sold as an indoor pet, unless it is being closely monitored while outside. Under no circumstances can this animal be sold, leased or given to a pet shop, research laboratory or humane society. The buyer understands that this kitten/cat(s) is being sold without breeding rights. (Pet only)
Deposit
The buyer is placing a deposit on a kitten/cat(s) from KittyCatKat, LLC. Kitten/cat(s) shall be reserved with a non-refundable deposit with a minimum of $300 per kitten unless otherwise stated by the breeder.
Deposits can be made at any time to reserve a potential kitten. This deposit secures the buyers position on the Breeder/Seller’s waiting list in the order in which the deposit has been received.
The buyer understands that the deposit made to KittyCayKat, LLC is non-refundable, unless KittyCayKat, LLC fails to produce a kitten/cat(s) as agreed upon in a 18-month period. The buyer understands that this policy is in place to ensure that the buyer is committed to their kitten/cat(s).
The buyer understands that if a kitten/cat(s) does not become available within an 18-month period, the deposit will be refunded ONLY if the buyer has not refused other available kitten/cat(s) within that period. After a period of 18 months from the date of deposit, the buyer may elect to continue waiting on an available kitten/cat(s) or receive a refund.

Residual Payment
The buyer understands that the kitten/cat(s) available to the buyer is at the discretion of the breeder. A kitten/cat(s) of similar quality may be substituted if the original kitten/cat(s) becomes unavailable.
The buyer understands that he/she is responsible for all shipping costs if applicable, including but not limited to: Health, certificate/veterinary exam, Shipping crate, Rabies vaccine, Airfare and associated fees.
If the buyer is having the kitten/cats(s) they are purchasing shipped, all cost for shipping and full payment for the kitten(s) needs to be submitted 30 days before shipping occurs.
If the buyer is having the kitten/cat(s) transported (by any means) by the breeder, all costs for transport and the minimum deposit must be made upon receipt. Residual payment can be made either prior to pick up or at pick up.
If the buyer is picking up their kitten(s), residual payment can be made either prior to pick up or at pick up.
Health Guarantee
This kitten/cat(s) is guaranteed sound health upon delivery or arrival, and for a period of 72 hours thereafter if vetted within that time. Breeder/Seller guarantees this kitten(s)/cat(s) comes from a feline leukemia virus (FeLV), and feline immunodeficiency virus (FIV) free home. Failure to have the kitten(s)/cat(s) checked by a licensed veterinarian within 72 hours after the date of sale (or date cat(s) leaves the Cattery in the event the kitten/cat(s) is being shipped or delivered), will void any guarantee.
The new kitten/cat(s) is to be quarantined during that 72-hour period. If a veterinarian examines the kitten/cat(s) within 72 hours of the date the kitten/cat(s) arrives and a medical problem is found, the breeder/seller is to be notified immediately in order for the kitten/cat(s) to be returned for a replacement. The breeder will not be held responsible for any veterinary expenses. The kitten/cat(s) cannot be returned for compensation after the guaranteed period has expired and/or it has been exposed to another cat(s). Breeder/Seller will not honor any health guarantee if the kitten/cat(s) dies of a virus from contact with another animal not bred at this Cattery.
The buyer agrees to provide immediate veterinary care to this kitten/cat(s) if it shows signs of distress, illness, or injury. Failure to do so will render the guarantee null and void. Under no circumstances is the kitten/cat(s) to be destroyed prior to notification by the Buyer to the Breeder/Seller. If the kitten/cat(s) dies within 4 years due to a genetic or developmental condition, despite medical treatment, the kitten/cat(s) will be replaced ONLY if a licensed veterinarian certifies the cause of death. The defects include but are not limited to heart defects, hereditary kidney problems such as PKD or amyloidosis and severe immune system problems such as anaphylaxis. Note that we do not guarantee for FIP. FIP is an individual kitten/cat(s) problem.
A veterinarian autopsy/necropsy report (at the buyers expense) must be provided to verify the cause of death of the kitten/cat(s). The breeder/seller will replace the kitten/cat(s) with another kitten/cat(s) (which ever was purchased through this contract) of similar quality and value, as available. No cash refunds. If the breeder/seller needs to replace the kitten/cat(s), the buyer will be expected to pay for any shipping/transportation costs.
The Breeder/Seller will have completed all the age-appropriate vaccinations and all health care up until the kitten/cat(s) has been picked up by the buyer, including age-appropriate vaccinations against panleukopenia (feline distemper), calicivirus, and rhinotracheitis. This may include the vaccination for rabies. A copy of the kitten/cat(s) health record will be given to the buyer at the time of purchase. At that time, all health care will become the responsibility of the buyer. Be mindful that the stress induced in an animal (when going to a new home) may cause symptoms of illness, including upper respiratory infection, to appear in an otherwise healthy animal.
Kitten/cat(s) is being fed by the seller with: Raw in the morning and Evening. Nulo Freestyle Grain Free Cat & Kitten Food.
Litter being used by seller: Scoop Away unscented
Health and Wellbeing
Buyer agrees that if the kitten/cat(s) is found to be neglected or mistreated, Breeder/Seller shall have the unconditional right to reclaim the kitten/cat(s) without refund of purchase price. Buyer will be responsible for any veterinary bills directly incurred as a result of any neglect or mistreatment. Neglect shall include but is not limited to: being left alone without human companionship for periods in excess of 72 hours; lack of proper sanitary facilities; being caged for long period of time; poor diet; poor health, and otherwise poor condition. Mistreatment shall include but is not limited to: lack of proper food, lack of water, and physical abuse.
Buyer understands that if the kitten/cat(s) is declawed, it will render the guarantee null and void. Buyer understands that declawing is a mutilation involving the amputation of a large portion of the kitten/cat(s) toes and which is likely to alter the kitten/cat(s) temperament and health. Buyer agrees that Breeder/Seller cannot ensure the temperament or health of any kitten/cat(s) which has been declawed. Buyer agrees that this kitten/cat(s) was sold with the understanding that it would not be declawed.
Breeder/Seller recommends against administrating the FIP vaccination, as this vaccination has yet to be proven effective and may cause FIP. Breeder/Seller also strongly recommends using non-adjuvant vaccinations whenever possible.
Kitten(s) delivery on or after the age of 12 weeks of age. Exact date and location will be agreed upon between the buyer/customer and seller/breeder.
