KittyCatKat, LLC – Siamese & Balinese Kitten Purchase Contract

By making a payment, both parties agree this contract is true and binding. The buyer has read and agrees to the terms below, and all information provided is true and accurate.
The buyer acknowledges that he/she has read, understands, agrees to, and has received a copy of this contract. This contract is legally binding to the Parties. Both parties will retain a copy of this contract.
This contract is governed by the laws of the State of Ohio. Any legal action, claim, or dispute arising from this agreement shall be brought exclusively in Miami County, Ohio. Both parties consent to venue and jurisdiction and waive the right to a trial by jury.
This contract is between the buyer and KittyCatKat, LLC / Tina L. Humphrey, hereafter referred to as the Breeder/Seller.
Pick of kitten(s) follows deposit date.

Registration
Registration application will be provided after the buyer submits proof that the kitten/cat has been spayed or neutered. Pet kittens must be altered no later than 6 months of age. Retired adults may already be altered.
Registration is available through CFF (Cat Fanciers Federation) or CFA (Cat Fanciers’ Association), depending on eligibility and breeder discretion.
Pet Kitten / Cat Terms
This kitten/cat is sold as a companion animal and indoor pet.
This kitten/cat is not intended for breeding, resale, research, or placement in a shelter or rescue.
If at any point the buyer is unable to keep the kitten/cat, the buyer agrees to notify the Breeder/Seller prior to rehoming.

Deposit
A non-refundable deposit of at least $300 per kitten reserves the buyer’s place on the waiting list in the order deposits are received.
The buyer understands and agrees that the deposit is non-refundable under all circumstances if the buyer changes their mind, decides not to proceed with the purchase, delays pickup, fails to complete payment, or otherwise chooses not to take possession of a kitten/cat for any reason unrelated to breeder availability.
Deposits are refundable only if KittyCatKat, LLC fails to produce a kitten within 18 months, and the buyer has not refused suitable kittens offered during that time. After 18 months, the buyer may continue waiting or request a refund.

Residual Payment & Transportation
Kitten availability is at the discretion of the Breeder. If the selected kitten becomes unavailable, a kitten of similar quality will be offered.
The buyer is responsible for all transportation costs, including but not limited to: veterinary health certificate, carrier, rabies vaccination (if required), airfare, courier or animal nanny fees, and associated costs.
Kittens are not shipped. Transportation is provided by in-person hand delivery by the Breeder/Seller or via a third-party animal nanny or ground transport service.
Transportation costs are due at the time the deposit is paid.
Transportation fees may be refundable only if the buyer cancels within the cancellation timeframe allowed by the transportation provider, airline, or animal nanny.
Once transportation has been scheduled, ticketed, or paid for, and the cancellation window has passed, transportation fees become non-refundable, regardless of the reason for cancellation.
Residual payment for the kitten is due at or before pickup or delivery.

Health Guarantee – Initial Seventy-Two (72) Hours
The kitten/cat is guaranteed to be in sound health at the time of delivery or arrival and for seventy-two (72) consecutive hours thereafter, provided the following conditions are met:
- The kitten/cat must be examined by a licensed veterinarian within seventy-two (72) hours of delivery or arrival.
- The kitten/cat must be quarantined from all other animals during the initial 72-hour period.
- The Breeder/Seller must be notified immediately of any veterinary findings.
The seventy-two (72) hour period runs consecutively and is not extended due to weekends, holidays, weather, scheduling conflicts, or veterinary clinic availability. It is the buyer’s responsibility to arrange access to a licensed veterinarian in advance, including the use of emergency or urgent care clinics if necessary.
Observation of symptoms alone — including but not limited to sneezing, reduced appetite, vomiting, diarrhea, soft stool, eye discharge, or lethargy — without a veterinary examination does not constitute a claim under this guarantee.
Failure to complete a veterinary examination within the seventy-two (72) hour period voids this health guarantee in its entirety, regardless of reason.
If a medical problem is documented by a licensed veterinarian within the 72-hour period, the following applies:
- The Breeder/Seller must be notified immediately
- The kitten/cat must be returned to the Breeder/Seller for consideration of replacement
- No veterinary expenses, medications, diagnostics, or treatments will be reimbursed
The Breeder/Seller is not responsible for illness, injury, or death caused by:
- Exposure to other animals after leaving the cattery
- Environmental changes
- Stress related to transport or transition
- Diet changes after leaving the cattery
One-Year (1-Year) Genetic Health Guarantee (Replacement Only)
If the kitten/cat dies within one (1) year of the date of purchase due to a fatal congenital or hereditary defect, the Breeder/Seller will provide a replacement kitten of similar quality, as available.
This guarantee applies only if all of the following conditions are met:
- A complete necropsy is performed by a licensed veterinarian at the buyer’s expense
- The necropsy confirms a congenital or hereditary defect as the sole cause of death
- The condition is not related to infection, illness, injury, neglect, environmental exposure, improper diet, stress, or poor care
- The kitten/cat has not been declawed
- The kitten/cat was kept indoors only
- The kitten/cat received appropriate veterinary care and nutrition
- No refunds will be given — replacement kitten only
- The buyer is responsible for all transportation costs associated with the replacement kitten
This guarantee does not cover, but is not limited to:
- Upper respiratory infections (URI)
- Feline Infectious Peritonitis (FIP)
- Infectious, viral, bacterial, or fungal disease
- Parasites (including coccidia, giardia, and intestinal worms)
- Vaccine reactions
- Injury or accident
- Illness caused by poor care, obesity, or environmental conditions

Food & Litter
The kitten is fed:
● Meat diet in the morning and evening
● Purina Kitten Chow food free-fed
Litter used: Pine pellets
Health & Wellbeing
If the kitten/cat is found to be neglected or mistreated, the Breeder/Seller reserves the right to reclaim the animal without refund.
Neglect includes, but is not limited to: lack of food or water, poor sanitation, prolonged confinement, poor diet, lack of veterinary care, or physical abuse.
Declawing voids all guarantees.

Age of Release
Kittens go home at or after 12 weeks of age. Pickup or delivery date will be agreed upon by both parties.
Entire Agreement / Final & Binding Clause
This contract represents the entire agreement between the Buyer and the Breeder/Seller and is final and binding upon signature.
No modifications or amendments shall be valid unless made in writing and signed by both parties.
